DMCA Takedown Policy

Carfocal ("we", "our", "us") respects the intellectual property rights of creators and complies with the Digital Millennium Copyright Act (DMCA). This policy explains how copyright holders can request removal of infringing material and how users may respond.
By using Carfocal, you agree to abide by this DMCA Policy.
1. What the DMCA Is
The Digital Millennium Copyright Act is a U.S. law that provides a legal process for:
- Copyright owners to request the removal of unauthorized content posted online.
- Online service providers, like Carfocal, to comply with valid notices.
Carfocal follows the DMCA’s procedures and will act on notices that meet legal requirements.
2. Designated Copyright Agent
All DMCA notices must be sent to our designated agent:
Only copyright-related communications should be sent to this address.
Incomplete or improperly submitted notices may delay processing.
3. Submitting a Valid DMCA Takedown Notice
If you believe your copyrighted work has been posted on Carfocal without authorization, you must send a DMCA-compliant notice including all of the following:
3.1 Identification of the copyrighted work
Provide a description or a link to the original copyrighted material.
3.2 Identification of the infringing content
Include the exact URL(s) on Carfocal where the infringing material appears.
3.3 Your contact information
- Full legal name
- Address
- Telephone number
3.4 Good-faith statement
“I have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”
3.5 Perjury statement
“I swear, under penalty of perjury, that the information in this notice is accurate and that I am the copyright owner or authorized to act on the owner's behalf.”
3.6 Signature
- Electronic or physical signature
- Printed name (if electronic)
Only notices containing all items above can be processed.
4. What We Do After Receiving a Valid Notice
Upon receiving a valid DMCA notice, Carfocal will:
- Review the notice for legal sufficiency
- Remove or disable access to the allegedly infringing content
- Notify the user who posted the content
- Provide information on how to file a counter-notice
- Log the notice for compliance and recordkeeping
Carfocal may also restrict or terminate accounts of users who repeatedly violate copyright laws.
5. Submitting a DMCA Counter-Notice
If content you posted was removed and you believe it was taken down by mistake or misidentification, you may submit a counter-notice.
Your counter-notice must include:
5.1 Identification of removed material
State the content removed and its URL prior to takedown.
5.2 Your contact information
- Full name
- Address
- Phone number
5.3 Good-faith statement
“I have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.”
5.4 Consent to jurisdiction
“I consent to the jurisdiction of the Federal District Court for the district in which my address is located, or if outside the United States, the jurisdiction of the United States District Court for the Southern District of Florida.”
“I will accept service of process from the person who submitted the original DMCA notice or their agent.”
5.5 Signature
Physical or electronic signature.
5.6 After We Receive a Counter-Notice
- We forward your counter-notice to the original complainant.
- If they do not file a lawsuit within 10–14 business days, the removed content may be restored.
6. Repeat Infringer Policy
Carfocal enforces a strict repeat infringer policy.
A user may be classified as a repeat infringer if they:
- Receive multiple valid DMCA notices, or
- Repeatedly post content violating copyright law
Such accounts may face:
- Suspension
- Permanent termination
- Removal of all posted content
7. Abuse of the DMCA Process
Submitting false or misleading notices or counter-notices is illegal and may result in:
- Legal liability
- Civil penalties
- Platform account termination
Do not use the DMCA process to harass or silence other users.
8. Updates to This Policy
Carfocal may revise this DMCA Policy at any time. Significant updates may be announced on the site.
